NO FAULT DIVORCE IN MARYLAND

In Maryland, married parties may dissolve the marriage through an absolute divorce either based on either fault grounds or no fault grounds. At West Law Firm, we focus on helping individuals file divorce based on the no fault grounds of 12 Month Separation or Divorce or Mutual Consent.

12 Month Separation
An uncontested divorce is generally the least expensive way to dissolve a marriage in Maryland. The criteria for obtaining a divorce on the grounds of 12 Month Separation are:
  • The parties must have resided under separate roofs for a minimum of 12 continuous months
  • The parties must not have engaged in any sexual activity with one another for a minimum of 12 continuous months
  • The parties must not have any unresolved contentious issues regarding: alimony, marital assets, marital debt, child custody or child support
  • At least one party must attend the Divorce Hearing
MUTUAL CONSENT 
Divorce by Mutual Consent is typically the fastest and easiest way to dissolve a marriage in Maryland. The criteria for obtaining a divorce on the ground of Mutual Consent are:
  • The parties must have a signed Marital Settlement Agreement that addressed issues of Marital Property and Alimony
  • Neither may seek to rescind the Marital Settlement Agreement
  • The parties must have a signed Child Support and Child Custody agreement that is approve by the court if they have minor children in common
  • At least one party must attend the Divorce Hearing
